美国法院驳回针对帝亚吉欧「100%龙舌兰」标注的集体诉讼
美国纽约东区联邦法院法官Lashann DeArcy Hall于9月30日批准帝亚吉欧的驳回动议,驳回一项指控其Casamigos与Don Julio龙舌兰并非完全由蓝色韦伯龙舌兰酿造的集体诉讼。该诉讼由消费者Avi Pusateri、Chaim Mishulovin及日式餐厅Sushi Tokyo于去年5月对帝亚吉欧北美公司提起,指其误导消费者。按墨西哥龙舌兰法规,标注「100% de agave」的产品必须完全使用蓝色韦伯龙舌兰糖分。
A US court has dismissed a proposed class action that alleged Diageo’s Casamigos and Don Julio Tequilas were not made exclusively from Blue Weber agave.
Last week (30 September), judge Lashann DeArcy Hall of the US District Court for the Eastern District of New York granted Diageo’s motion to dismiss a complaint that claimed the company had misled consumers who purchased its Tequila brands.
Consumers Avi Pusateri and Chaim Mishulovin, and Japanese-inspired restaurant Sushi Tokyo, filed the class action lawsuit against Diageo North America in May last year.
In July, Diageo filed its initial response to the legal action, denying the allegations. It filed a motion to dismiss a similar class action lawsuit in Florida on 28 October last year, and several days later in New York.
Under regulations for Tequila in Mexico, products labelled ‘100% de agave’ or ‘100% agave azul’ must use sugars derived exclusively from Blue Weber agave.
The complaint argued that consumers paid a premium for Casamigos and Don Julio on the belief that the products met this standard.
