Michigan has signed a bill that caps the state liquor board’s fees for delivering products, a move that will have a “long-lasting impact” on the spirits industry.

Michigan governor Gretchen Whitmer has signed into law Senate Bill (SB) 604, which went into effect yesterday (29 July). It caps the fees that spirits suppliers are required to pay Authorised Distribution Agents (ADAs) per case of spirits purchased by the Michigan Liquor Control Commission (MLCC). Spirits companies have to pay a fee of US$1.75 per case to their ADA. Under the new bill, neither the liquor board nor the state treasurer can adjust this amount, but spirits suppliers and ADAs can independently agree on a higher limit. The Michigan Spirits Association (MSA), which has called for the measure to be implemented for several years, has welcomed the move. “The signing of SB 604 will have a long-lasting impact on the spirits industry,” said MSA president Sam Awdish. “Capping what spirits suppliers are required to pay to have their products delivered on behalf of the state fixes costs for our member companies and saves consumers from potential price increases as delivery costs get passed on.” In addition, SB 604 increases the fee the MLCC is required to pay to ADAs to offset costs to US$12.50 per case, which will be based on the Consumer Price Index (CPI). The CPI will be adjusted every year on 1 October with a maximum hike of 5%. The bill also enables the MLCC, with the approval of the State Administrative Board, to make additional payments to distribution agents based on a methodology that will be established by the liquor board. This method must reflect ‘reasonable and necessary costs’ related to warehousing, distribution and logistics, and be applied across all ADAs. “Michigan retailers, restaurants and taverns rely on a strong distribution system to meet adult consumer demand for distilled spirits products,” added Andy Deloney, senior vice-president and head of state public policy of trade body the Distilled Spirits Council of the US." “Senate Bill 604 provides additional support for the Michigan Liquor Control Commission and helps ensure Michigan’s distribution system can continue to serve retailers and consumers in the years ahead. " According to data from the National Alcohol Beverage Control Association (NABCA), Michigan was one of only four US control states to grow their spirits volumes in May, but this was boosted by three additional selling days. The state's spirits sales rose by 1.3% in May 2026 compared with the same month last year, while value dipped by 0.7%. In 2023, Michigan-based producer Journeyman Distillery opened its second location in the Midwest – a US$40 million campus in Indiana.
